The editor of the site is Soothe Daily, a sole proprietor company registered in Ontario.

Hosting of the site is provided by WIX, whose head office is located at 40 Namal Tel-Aviv Street in Tel Aviv, Israel.

Preamble

We attach as much importance to the relationship with our customers as to transparency and honesty in how we operate. Therefore, we wanted to share with you our Terms of Use including our privacy policy to notify you of the information we collect, how we use it, to whom we can transmit it and how to access, modify or remove them from our system.

We treat all your personal information ("Personal Information") as confidential (subject to what is provided in these Terms of Use). They are kept on a secure server, and we comply with data and consumer protection legislation.

1 - Access to the website

These Terms of Use (which include our privacy policy) apply without restriction or reservation to all the services offered by Soothe Daily on its website www.soothedaily.com (hereinafter "the Site"). They constitute, with our General Conditions of Sale, the entire agreement concluded between the Company and the user of the Site (hereinafter "the User").

These Conditions of Use are accessible at any time on the Site and will prevail over any other version or any other contradictory document (except for the General Conditions of Sale).

Our Site is regularly updated, so we may change the content at any time. If necessary, we reserve the right to interrupt access to our Site, or even to close it for an indefinite period. However, we are under no obligation to update and accept no responsibility if certain information is no longer up to date.

2 - Creation of an account

Once you place an order on our Site, an account will be created by providing the information required in the electronic form created for this purpose.

The User declares that the personal information indicated during registration is complete, accurate and allows him to be identified precisely. We hold all intellectual property rights attached to the content of our Site, subject to rights belonging to third parties and content posted by third parties, for which we hold a license.

The content of our Site is protected by copyright law and by other laws in Canada and in other countries.

3.2 - Intellectual property - Use of the content of the Site (for non-commercial purposes)

You are free to print a copy and download extracts from certain pages of our Site for your personal use and to draw the attention of other people (belonging to you) on the content of our Site.

However, you cannot modify, in any way, the paper or digital copies printed or downloaded from our Site, and you must not use any illustration, photograph, video or audio sequence, or any graphic independently of the text relating to it.

3.3 - Intellectual property - Creation of a link to our Site

You can create a link to the home page of our Site (to the exclusion of any other page of the Site), provided that this link is created in accordance with the laws in force and that it does not damage reputation of our Site and does not allow you to take advantage of it.

In addition, the creation of this link should in no way suggest the existence of any form of association between you and the Company, or any approval or support from us.

The creation of a link to our Site from a site that does not belong to you is strictly prohibited.

Our site must not be framed by any other site whatsoever, and the creation of any link to any other page of our Site that the home page is prohibited. We reserve the right, if applicable, to withdraw our consent at any time without notice.

3.4 - Intellectual property - Other uses

3.5 - Intellectual property - Misuse of the Site

You must not abuse our Site, nor knowingly introduce viruses, Trojans, etc. or any other malicious or technologically harmful material.

You must not attempt to gain fraudulent access to our Site, the server that hosts it or any other server, computer or database linked to our Site. You must not attack our Site via a “denial of service attack” or “a distributed denial of service attack”.

We will report any violation to the relevant law enforcement authorities and give them our full cooperation by disclosing your identity, if necessary.

In the event of an infringement, we reserve the right to immediately delete your user account and to prohibit you from accessing our Site, temporarily or permanently.

We cannot be held responsible for any loss or damage caused by an attack by distributed denial of service, virus, or other technologically harmful material, which could infect your computer equipment, your computer programs, data, or other material, and which would be due to the use of our Site or to the downloading of any element accessible on this Site as well as on any linked site.
